Chinese earthquake that killed 80,000 people in May of 2008 most likely was not an act of God, a study released today has found. Chinese authorities denied it, saying that epicentre of quake was too deep and on an unrelated fault and, therefore, not a case of reservoir-induced seismicity. But Chinese authorities appear to have been wrong on both counts, says Mr. Fan. Zipingpu reservoir’s apparent triggering of Wenchuan earthquake is an unprecedented case of reservoir-induced seismicity that presents huge challenges for scientific theory. Could widespread and largely unchecked dam-building in China’s southwestern region, where stress field area is large and high risk, as indicated by UN’s Global Seismic Hazard maps, trigger RIS events that could in turn trigger larger regional earthquakes? Could this case of Wenchuan tectonic earthquake, induced by a reservoir, still be defined as a traditional case of RIS, or must science of RIS be redefined to anticipate full consequences of dam building? These are challenging and fundamental questions that world’s scientists must confront as they investigate important case of Zipingpu reservoir and Wenchuan earthquake of May 12, 2008.

GOLDMAN SACHS BUYS $40 MILLION OF WARRANTS IN DRAKE & SCULL

Goldman Sachs Group Inc. bought warrants representing about 8.5 percent of the market value of Drake & Scull International PJSC, (DSI) a Dubai-based supplier of engineering services to the construction industry. The warrants have a notional value equal to 147 million dirhams ($40 million) with a five-year maturity and can be exercised after two years, Drake & Scull said today in a statement to the Dubai stock market. The company, whose shareholders include HSBC Private Bank, reported a 93 percent drop in third-quarter profit, missing analysts’ estimates. Drake & Scull said on Nov. 14 that it obtained a $120 million loan, coordinated by Goldman Sachs, (GS) to help it pursue “growth plans in North Africa, Asia and other growth markets and provide the liquidity to capitalize on various private public partnership projects.” Third-quarter profit retreated to 3.92 million dirhams, from 57.5 million dirhams a year earlier as contracting revenue dropped 26 percent, the company said in a statement yesterday. The median estimate of four analysts was for a profit of 37.8 million dirhams, according to data compiled by Bloomberg. The decline reflected a slowdown in the construction industry, according to the company. Productivity rates dropped across projects in the Gulf Cooperation Council countries and Africa, while the procurement cycle dipped because of the summer holiday season, Chief Financial Officer Osama Hamdan said in the statement. Drake & Scull has an order backlog of 7.5 billion dirhams, it said. Drake & Scull fell 4.3 percent to 71.8 fils at 1:59 p.m. in Dubai today. The stock declined 4.3 percent this year compared with a 17 percent advance for the benchmark DFM General Index.

Egypt to increase imports of Algerian gas by 50%

(MENAFN) Algeria‘s Foreign Minister, Murad Mdelci, announced that his country would increase its gas exports to Egypt by 50 percent, reported Kuwait News Agency (KUNA). Qatar Emir’s Gaza Visit Shifts Focus Onto Palestinian Unity

The visit of the Emir of Qatar, Sheikh Hamad Bin Khalifa Al-Thani, to the Gaza Strip raises big questions: Will Qatar and its Emir reinforce the separation between the Gaza Strip and the West Bank, and abandon the efforts to end the state of division which culminated in the Doha Agreement? Or will the visit carry a surprise? Here, it is fair to assume that the Emir and his delegation will travel to Ramallah and announce the initiation of the implementation of the Doha Agreement, though there have been no introductions or preparations for such a step. This reinforces the belief that the step is a unilateral one [taken by Qatar]. This implies the following: First, Qatari legitimacy will be granted to the sacked, rebellious, divisive and illegal government of Hamas, which took power through a military coup in 2007. Separation between the Gaza Strip and the West Bank will be reinforced. This situation will further weaken Palestinian cohesion in the face of the fiercest Israeli settlement activity yet, which undermines the components of the Palestinian state. Second, Qatari legitimacy will be lent to the principle of using force to resolve internal differences. This principle has been used by Hamas through military coups, controlling institutions by force, and imposing the authority of a single party. This has led to the violation and indefinite disablement of the democratic process. The terms of the Legislative Council and the presidency expired two years ago, but no elections have so far been held. Disrupting the reconciliation means not resorting to the people as a reference, in line with the principle of political Islam: You commit to democracy once and only once. Third, Hamas will be rewarded for having disrupted the implementation of the Doha Agreement and linking the reconstruction of the Gaza Strip to [the Doha Agreement]. This contradicts the Cairo and Doha Agreements and the results of the Palestinian National Dialogue, which put the task of reconstruction on the agenda of the National Unity Government, in the context of strengthening the unity of the Palestinian homeland and the integrity of its institutions. Fourth, in this senior official visit, the Qatari government overrode the Palestine Liberation Organization (PLO) as the sole legitimate representative of the Palestinian people, and as the National Authority’s reference in the occupied territories that has the right to withdraw confidence from any Palestinian government.

The PLO deemed the government of Hamas Prime Minister Ismail Haniyeh illegitimate and called for its dismissal after its bloody coup in the Gaza Strip. Also, the Legislative Council is part of the National Council, which has the right to intervene in all aspects of Palestinian affairs. The historical, voluntary absence of Hamas and the Islamic Jihad from PLO institutions does not mean that their legitimacy should be removed, but means that we should include these factions in the PLO institutions under its main system. The reconciliation agreements provide for settling this issue through  elections. Fifth, the Arab League has endorsed the positions of the Palestinian legitimate representative in line with the Arab League Charter. It has refused to deal with the sacked Hamas government and has deemed it illegitimate. Even the government of Tehran, which has strong ties with Hamas, refrained from inviting Ismail Haniyeh to the [Non-Aligned Movement] Summit as it contradicts with the Palestinian legitimacy approved by the Islamic countries. This visit is a violation by Qatar of the Arab League’s position. Former presidents who have surpassed the organization and sought to adopt an alternative to it are Saddam Hussein — who later backed down — Moammar Gadhafi, and Hafez and Bashar al-Assad. They did so in the context of employing the Palestinian factor as a bargaining chip. But they did not succeed. Sixth, if the State of Qatar has reneged on its efforts toward Palestinian reconciliation, does this mean that it supports the establishment of an Islamic emirate or state in the Gaza Strip? This is a logical conclusion even if the intent is otherwise. The question is: What would the function of such a state be? Would it be a substitute for the states in the West Bank and the Gaza Strip, or a [temporary] station to transfer control to the West Bank? The most important question is: What is the program of the “emirate” to resolve the national question? Theoretically, Hamas claims that Palestine — from the River Jordan to the Mediterranean Sea — is an Islamic state, that it does not recognize the state of Israel and endorses a long-term truce. Practically, Hamas is allowing Israel to impose the project of division of roles, with the population being given to political Islam and the land to the occupying state, in addition to dropping the Palestinian demand for ending the occupation and settlement activity. Hamas’ experience in controlling security across the Gaza borders is reassuring and encourages the Israelis to reinforce their control over the West Bank. What is common between the legitimate authority in the West Bank and the sacked authority in the Gaza Strip is security control and suppressing all attempts of resistance, through security coordination and the adoption of the slogan of resistance and preparing for confrontation. But the lesson is [reflected] in the result, which is suppression. The difference between the two authorities is that Ramallah has demanded a cessation of settlement activity, ending the occupation — including the city of Jerusalem — resolving the refugee problem and establishing a Palestinian state. On the other hand, the authorities in Gaza have demanded the establishment of an Islamic Palestine and deemed anything else unacceptable. The emirate project converges with the Israeli project. So, does the state of Qatar support it? Qatar may have hidden tactical motives. Qatar may possibly be seeking to break off Hamas’ relationship with Iran and prevent Iran from using Hamas in the event of an Israeli-US military strike. An informed source has said that Iran provides $15 million in monthly aid to the sacked government, which was the reason behind the predominance of the pro-Iranian direction within Hamas over the direction which calls for turning against Iran “in line with the positions of the Muslim Brotherhood.” In this case, the Emir of Qatar might seek to persuade the Iranian current within Hamas against aligning with the Iran axis in exchange for Qatari support. In any case, all attempts to use the Palestinian cause and its political extensions as leverage in this or that battle, particularly in regional conflicts, have failed. There is a correlation between the weakness or division on the Palestinian political arena and the increasing [foreign] interventions. The Need for Establishing a National Human Rights Institution in The UAE – OpEd

Standards, norms and values of international human rights law have long been generated at a universal level but depend for their implementation upon institutions at the local level. Over the past two decades, one phenomenon has become widely celebrated as the key to making human rights matter and that is the spread of national human rights institutions (NHRIs) around the world. In 1991 a United Nations-sponsored consultation on ‘national human rights institutions’ resulted in a landmark statement entitled ‘Principles Relating to the Status and Functioning of National Institutions for the Protection and Promotion of Human Rights’, since known as the ‘Paris Principles’. With consultations from government representatives, UN agencies, non-governmental organizations, and regional human rights bodies, the Principles established guidance on the status, powers and functioning of NHRIs. United Arab Emirates NHRIs today play a crucial role in the domestic implementation of national human rights norms. They are the new actors in the human rights arena, and many have now been established to strengthen the domestic mechanisms for human rights protection and promotion. With them have come great expectations at national level, not only to implement human rights and to protect people’s fundamental freedoms, but also to provide a bridge between international and national human rights protection systems. The UAE is already party to numerous international human rights instruments that offer valuable guidance to government and confirm the commitment of the government to promote and protect human rights. However, the UAE’s free market economy has experienced phenomenal growth over a very short time span. The UAE has become the golden gate of the Arab World and the outstanding symbol of change in the region. The scale of its socio-economic development has made it a major destination for traders, investors, recruiters, tourists, labourers (legal and illegal), and even crooks and criminals. The economic development of the country has not only brought prosperity for the nation but at the same time has led to many social crises including problems of human rights. Neighbouring countries of the UAE such as Qatar, Jordan and Oman have already established human rights institutions, as bodies independent of government, to promote and protect human rights and civil liberties. Is it not time that the UAE established also one? This article argues why the establishment of such a commission is essential and sets out reasons why the UAE needs a separate constitutional body to deal with human rights issues. First, the international community increasingly recognises NHRIs as essential for ensuring effective national implementation of international human rights standards. Moreover, NHRIs not only help to ensure effective implementation, but they are an important repository of human rights knowledge and experience. Second, an NHRI is needed not only to protect the rights of people that are infringed but also to promote a culture in which such infringement is far less likely to occur. There are significant gaps in the protection provided by the court, by parliament, by governmental departments and by NGOs and INGOs. A national institution is vital not only to provide remedies but also to promote a change of culture among public bodies, thus reducing the need for litigation. This will not happen without a statutory body as a means for change. Third, in today’s world, human rights institutions play a legitimizing role. To be specific, as critics argue, NHRIs ‘signal the stamp of democratic legitimacy on the deal arrived at: they constitute part of the ‘politically correct’ approach to constitutionalism.’ As an NHRI occupies a unique space between government and civil society, its location close to government places it in a position to engage with government officials and influence policy, and an access that few other organizations have. It also enables it to negotiate with non-governmental actors and act as an umbrella for human rights NGOs. Fourth, human rights are not only a matter of law, essential though that protection is, but an ethical code which requires people to treat each other with dignity and respect. The new body in the UAE would conduct public inquiries, assist the UN in scrutinizing the country’s record on human rights, and speak on issues which the government or other state functionaries may avoid. It would have authority to speak on human rights issues for the country as a whole, and other national institutions would be likely to benefit from it. Finally, NHRIs are created largely to satisfy international audiences; they are the result of state adaptation. An NHRI can act as a bridge between those who govern and those who are governed. It can guide the country towards a more democratic and human rights regime and enhance the nation’s reputation in the international arena. Respect for the human rights of others is the essence of social responsibility and of peoples’ mutual obligations, be it towards those to whom public services are provided or simply towards neighbours and family. Therein lies the issue of a culture of human rights. Thus the establishment of an NHRI similar to those in neighbouring countries will be an important step in this regard. The key elements of any such NHRI should be its independence and its non-political nature. The Paris Principles emphasize that NHRIs should be established with a constitutional or legislative mandate in order to safeguard their independence. They emphasize the need for competence and ‘as broad a mandate as possible’. Their responsibilities include giving advice to government, parliament and others, examining legislation and administrative measures for compliance with human rights standards, considering violations, preparing reports on human rights matters, reacting to events, plus teaching and research. Thus, the NHRI must establish a close, yet independent, relationship with government, if it is to have any influence over policy and government decisions. It is important that the UAE takes this initiative to join fully the international human rights culture, thus becoming part of an international community that is committed to upholding the highest standards of international human rights. An NHRI independent from government, and based on solid legal or constitutional foundations and capable of cooperating with civil society, the media, the NGOs/INGOs and the wider public is vital to the country. Its duties must include the provision of guidance to public authorities, as well as to private and voluntary bodies about their human rights obligations. It should monitor the level of respect shown on human rights and advise the government on the adequacy of existing laws and practices. The UAE is already committed to becoming a model for change in the region and to working as an active member of international community. It welcomes collaboration with other governments and international organizations that share the same vision of stemming the tide of fundamental freedom violations. The UAE strongly defends the United Nations mechanisms that promote the principles of the Universal Declaration of Human Rights. In tackling its human rights challenges, the UAE is resolute about improving its own record and contributing effectively at international level. This aspiration also stems from its cultural heritage and religious values, which enshrine justice, equality and tolerance. The establishment of an NHRI in the country will open new doors for the UAE. It will guide the country towards even greater success as well as greater respect in the international political forum. The time is right: the choice awaits.
